Cookies

Contact form

Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission. We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed. We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this Provision.

Booking a consultation appointment

If you book a specific consultation appointment for selected products using the function provided for this, your data (name, e-mail address and desired appointment, as well as the product you are viewing) will be transmitted to the relevant specialist consultant and also stored on our website. This enables you to cancel your appointment at any time. After the appointment has expired, this data is automatically pseudonymised. After three years, the data will be deleted automatically.

The processing of the data entered in the consultation form is thus based on your consent (Art. 6 (1) (a) GDPR). You can revoke this consent at any time. To do this, click on the corresponding cancellation link in the confirmation e-mail. The legitimacy of the data processing operations carried out up to the point of revocation remains unaffected by the revocation. The storage of the pseudonymised consultation inquiries is based on our legitimate interests (Art. 6 (1) (f) GDPR, proof of a valid double opt-in).

5. Analytics and Advertising

Google Analytics

This website uses Google Analytics, a web analytics service. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. Google Analytics cookies are stored based on Art. 6 (1) (f) DSGVO. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising.

IP anonymization

We have activated the IP anonymization feature on this website. Your IP address will be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there. Outsourced data processing

We have entered into an agreement with Google for the outsourcing of our data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics. 

Facebook Pixel

This website uses visitor action Facebook Pixel to measure conversion rates. This service is provided by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Facebook, the data collected is also transferred to the USA and other third countries.

This allows the behaviour of site visitors to be tracked after they have clicked on a Facebook advertisement and have been redirected to the provider's website. This allows the effectiveness of Facebook adverts to be evaluated for statistical and market research purposes and to optimise future advertising measures.
 
The collected data is anonymous to us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes, according to the Facebook Data Usage Policy. This allows Facebook to enable adverts to be placed on pages within Facebook and outside of Facebook. As the website operator we have no influence over the use of the data.

The use of Facebook Pixel is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in effective advertising measures, including social media. If a corresponding consent has been requested (e.g. consent to the storage of cookies), data processing is performed exclusively on the basis of Art. 6 (1) (a) GDPR; this consent can be revoked at any time.

6. Plugins and Tools

YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here the YouTube server is informed about which of our pages you have visited. If you're logged in to your YouTube account, YouTube allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account. YouTube is used to help make our website appealing. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO. 7. If you want to establish a business relationship with us

in-akustik only supplies specialist dealers (B2B). For this reason, we require some Basic information about your company before we can establish a business relationship with you. This information includes personal data. We collect the following data for our customer master data record:

We process these data on the basis of Article 6(1)(a) (consent — you share these data with us on a voluntary basis), Article 6(1)(b) (contract or taking steps prior to entering into a contract) and Article 6(1)(f) (legitimate interests — in-akustik wants to ensure that only business customers are included in the customer database).

Transfer of your data:

We will transfer your data for verification in-house. We may also perform a credit check in
certain circumstances, in which case we will make use of the services provided by Euler Hermes.

As soon as we have registered you as a specialist dealer, your contact details will be shared

Duration of storage:

We will store your customer master data record for the duration of our business relationship
with you. Your completed customer master data record will be destroyed immediately if we
do not conclude a specialist dealer agreement with you.

You have the right to withdraw the aforementioned consent with effect for the future. Any
mandatory statutory provisions — in particular retention periods — will remain unaffected
by this. The rights specified under point 2 of this Privacy Policy also apply

8. If you contact us as a private customer

Feedback cards:

It is in our interest to find out what we can do better or which products you as a “user” especially like. For this reason, we include feedback cards with some of our products and ask you to return these to us if you so wish.

We collect the cards and store your feedback electronically and anonymously. The Cards themselves are disposed of in accordance with data protection legislation within one year

Registration and guarantee cards:

You can register some in-akustik products with us. In such cases, we process the data that you share with us on the registration card. In general, these data consist of your address and contact details. We manage these data in a separate database and only use them to satisfy your claims (guarantee claim handling) or to advise you (e.g. when you make an enquiry about suitable complementary products). One year after you have submitted your guarantee or registration card, we will send you a one-off “anniversary letter” in which we will inform you about suitable new products or give you the opportunity to share some
constructive criticism with us.

Data processing for orders received for the “HEAVENLY HOME TRIAL” promotion

In order to carry out your order, we process only the necessary data, which you have shared with us by filling in the order form (hereinafter referred to as “contract data”). The contract data shall include

Data processing for the aforementioned purpose shall be carried out on the basis of Article 6(1)(b) GDPR (performance of a contract). We store your contract data for as long as is necessary in order to fulfil the stated purpose (carrying out your order, accounting etc.). After that, we retain the contract data only for as long as and to the extent that we are legally required or permitted to do so (e.g. for the purpose of exercising legal claims).

Why we process these data and what rights you have:

We process these data solely for the purpose of continuously improving our services and the quality of our products (Article 6(1)(a) GDPR — your consent (you share these data with us on a voluntary basis) and Article 6(1)(f) GDPR — legitimate interests) or of processing guarantee claims (Article 6(1)(b) GDPR — performance of a contract). We do not disclose these data to third parties without your express consent.
No automated decision-making takes place. You have the right to withdraw the aforementioned consent with effect for the future. Any mandatory statutory provisions — in particular retention periods — will remain unaffected by this. The rights specified under point 2 of this Privacy Policy also apply.

9. If you apply to work for us

Why we process these data:

We process your application data for the sole purpose of selecting suitable applicants to employ. We do this on the basis of Article 88 GDPR in conjunction with Section 26 of the new version of the German Federal Data Protection Act — BDSG(neu) (“Data processing for employment-related purposes”).

Your application data may be shared in-house with the following departments: HR department, senior management team, the specialist department requiring staff in your field or the department actively recruiting for staff.  We rarely transfer data to countries outside the EU or use automated decision-making.

Duration of storage:

If we employ you, we will add your application data to your personnel file. If your application is unsuccessful, your application data will be deleted within six months, unless you give us your express written consent to store your data in our pool of applicants. You can withdraw this consent at any time.

Your rights:

You have the right to withdraw the aforementioned consent with effect for the future. Any mandatory statutory provisions — in particular retention periods — will remain unaffected by this.
The rights specified under point 2 of this Privacy Policy also apply.

10. If you vistit our Facebook profile

Data processing by social networks

We maintain publicly accessible profiles on social networks. Detailed information about the social networks which we use can be found further below.

Social networks such as Facebook, Instagram etc. are generally able to extensively analyse your user behaviour when you visit their website or a website with integrated social media content (e.g. Like buttons or advertising banners).

Visiting our social media pages will trigger numerous processing operations relevant to data protection.

Specifically:

If you are logged in to your social media account when you visit our social media page, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or if you do not have an account on the respective social media portal. In this case, data is collected for example via cookies which are saved on your end device or by recording your IP address.

The social media portal operators are able to use data collected in this way to create user profiles in which your preferences and interests are stored. You may thus have advertising displayed which is related to your interests both within and outside the respective social media page. If you have an account on the respective social network, the advertising related to your interests can be displayed on all devices on which you are or have been logged in.

Please also note that we are unable to retrace all operations processed on the social media portals. Depending on the provider, further processing operations may therefore be performed by the social media portal operators.

Legal basis

Our social media pages are intended to ensure we have the most extensive presence possible on the Internet. This is a legitimate interest in accordance with Art. 6 paragraph 1, letter f of the GDPR. The analysis processes initiated by the social networks may have different legal bases; these must be specified by the social network operators (e.g. consent given in accordance with Art. 6 paragraph 1, letter a of the GDPR).

Responsible party and enforcement of rights

If you visit one of our social media pages (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered by this visit. You are entitled to exercise your rights (information on, notification, deletion, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. against Facebook).

Please note that, despite our joint responsibility with the social media portal operators, we cannot fully influence the data processing operations of the social media portals. Our options are primarily geared towards the company policy of the respective provider.

Storage period

The data actually collected by us via the social media page will be deleted by our systems as soon as there is no longer any reason for storing it, you request us to delete it, you revoke your consent to it being stored or the purpose for storing the data ceases to apply. Cookies which are stored on your end device will remain there until you delete them. Mandatory legal provisions – esp. retention periods – remain unaffected.

We have no influence over the storage period of data of yours which is stored by the social network operators for their own purposes. Further details on this matter should be obtained directly from the social network operators (e.g. from their privacy policy (see below).)
